Press in Bike Lane

Metro Networks Press Vehicle parked in the Centre Street Bike lane on a friday afternoon. Hard to tell if the Permit is valid, hidden behind the inspection tag. Seems that the license plate in the front window may be expired.

I hate the press but the guy was clearly by his car thus making this a moot point. A vehicle is not to be issued a summons if the driver is present. Is this the best this site can do?

A summons is issued to the driver and not the vehicle if the driver is present. NYS VTL 238.2, it's one of Gridlock Sam's (Daily News) soapboxes. Until we pointed outr that the PVB judges were interpreting the law to mean "in the driver's seat"

If you are there and can see the agent's eye color, you are there. You don't have to be in the seat to do it. But the system being corrupt from top to bottom, it cost $50 to make the claim and be ignored.

When we called him (Gridlock Sam) on it, he went silent.

And just because he's with the car, doesn't mean he's not in the way and not illegally parked.

EdPolecat, here's VTL 1200 for you:

(b) When standing is prohibted by this article, or by local law,
ordinance, order, rule or regulation, no person shall stand or park a
vehicle, whether occupied or not, but may stop temporarily for the
purpose of and while actually engaged in receiving or discharging
passengers.

Note the part that says "whether occupied or not." He's not actually engaged in receiving or discharging passengers.

If someone's double-parked, by a hydrant or in a driveway, being by the car is a mitigating factor because they can just hop in and move it. But I doubt this guy is going to jump in and move the car if he sees a cyclist coming along the bike lane, so the fact that he's with the car is irrelevant.
